Important Changes for NYC Property Owners: 2025 Compliance Deadlines

As 2025 approaches, New York City property owners must prepare for several critical compliance deadlines set by the Department of Buildings (DOB). Staying informed and proactive is essential to avoid penalties and ensure the safety and legality of your properties. Here are the key mandates to be aware of:

1. Local Law 31: Lead-Based Paint Inspections

  • Deadline: August 2025
  • Requirement: All residential buildings constructed before 1960, and those built between 1960 and 1978 with known lead hazards, must undergo comprehensive lead-based paint testing using X-Ray Fluorescence (XRF) technology. Annual inspections are mandatory, especially for units housing children under six.
  • Action Needed: Engage certified inspectors to conduct XRF testing and address any identified lead hazards promptly to ensure compliance.

2. Local Law 152: Gas Piping System Inspections

  • Deadline: December 31, 2025
  • Requirement: Periodic inspections of gas piping systems in most residential and commercial buildings are mandated every four years. Inspections must be performed by a Licensed Master Plumber (LMP) or their qualified representatives. Single-family homes and certain two-family homes without gas piping systems are exempt.
  • Action Needed: Schedule inspections with an LMP, address any issues promptly, and submit the Gas Piping System Periodic Inspection Report (GPS1) to the DOB within 60 days of the inspection.

3. Local Law 126: Parking Structure Inspections

  • Deadline: December 31, 2025
  • Requirement: Local Law 126 mandates routine inspections of parking structures in NYC, with the first compliance window opening in 2024. Owners must ensure inspections are conducted by Qualified Parking Structure Inspectors (QPSIs).
  • Action Needed: Ensure that your parking structures are inspected by a QPSI and that any necessary repairs are completed to maintain structural integrity and safety.

4. Local Law 11: Façade Inspection & Safety Program (FISP)

  • Update: The DOB has initiated a comprehensive review of the city's Façade Inspection & Safety Program, commonly known as "Local Law 11." This study aims to evaluate current façade inspection regulations and may lead to potential legislative changes.
  • Action Needed: While no immediate changes are in effect, property owners should stay informed about potential updates to façade inspection requirements and continue to comply with existing FISP mandates.

5. New Electrical Code

  • Effective Date: December 2025
  • Update: The New York City Council has approved a comprehensive update to the NYC Electrical Code, the first revision since 2011. An effective compliance date for all new projects is set for December 2025.
  • Action Needed: Review the updated electrical code provisions and ensure that any new electrical work planned aligns with the new standards before the compliance date.

6. Civil Penalties for Failure to File Retaining Wall Report

  • Update: Beginning with Cycle 3, owners who fail to file an acceptable retaining wall compliance report with the Department of Buildings by the due date will be subject to civil penalties.
  • Action Needed: Ensure timely filing of retaining wall compliance reports to avoid penalties.

7. Hoisting Machine Operator (HMO) License Requirements

  • Effective Date: November 7, 2024
  • Update: Beginning November 7, 2024, an HMO license issued by the Department of Buildings will be required to operate an articulating boom crane, mini crane, or rotating telehandler in New York City. New classes of limited HMO licenses for operators of these equipment types have been created.
  • Action Needed: Operators should obtain the necessary HMO licenses before the effective date to continue lawful operation of the specified equipment.
